Hearing to Overturn UIGEA Set for September - 07-12-07

July 12 - There is great news for online gambling fans living in the United
States and indeed for the online gambling fraternity as a whole, with the
announcement that a hearing to have the Unlawful Internet Gambling Enforcement
Act (UIGEA) overturned has been set for September this year.
A New Jersey Federal Judge has set a court date for September 4th to hear the
lawsuit of the Interactive Media Entertainment & Gaming Association (iMEGA)
versus US Attorney General, Alberto Gonzales to have UIGEA, the US anti-online
gambling law reversed.
The case will be heard by Judge Mary L. Cooper of the US District Court in
Trenton, New Jersey, where it will be iMEGA's objective to have the court both recognize and declare UIGEA unenforceable as well as unconstitutional.
According to the Interactive Media Entertainment & Gaming Association, the
Unlawful Internet Gambling Enforcement Act which was passed by US Congress at
the end of 2006 and signed into law by hillbilly Bush soon thereafter, violates
the US First and Tenth Amendments.
Said? iMEGA president, Edward Leyden, 'We think that UIGEA is an
infringement of these Amendments and also
that the US government has overstepped its authority which has resulted in the
high-publicized WTO dispute with Antigua.'
Judge Cooper is expected to review the legal briefs submitted by the plaintiff (iMEGA)
and the defendants (US agencies) to decide whether or not she will grant iMEGA's
request for a temporary restraining order to prevent UIGEA from being enforced.
